Audio device not being closed consistently?

Description
I have noticed that I am getting errors on a regular basis where I try to watch a record show and mythtv is unable to open the audio device, and the solution is that I need to exit mythtv frontend and restart to get access to the audio device again.
I am using alsa audio and output to spdif. which doesnt allow multiple access to the sound card.

I am running the latest version availble from the svn repository ... currently revision 23126 (current as of jan 13, 2010)

Looks like a PulseAudio? issue and not myth.
Disable pulseaudio server.

Plus that part of the code doesn't exist anymore
What version of Myth are you running.
Please provide a log where the error shows
